Guardian Ad Whatum?

As you can tell, I’ve been neglecting the blog lately. What can I say; I’ve been very busy, partly because I’ve been appointed guardian ad litem in several cases in the past two weeks.

What is a guardian ad litem (GAL)? Literally, it means guardian for the suit. Very often, a lawsuit involves a child or someone else that the law considers incompetent. The court will sometimes appoint somebody, not necessarily a lawyer, who is to represent the child’s best interests. usually, the GAL will interview parents, the child(ren), and others involved in the lawsuit and then make a written report to the court.

In Mississippi, there are many different situations in which a GAL may be appointed. Anytime child custody is at issue, the court may appoint one, and of course, anytime neglect is alleged, the court must appoint a GAL.

Usually, the fees of the GAL are split equally between the parties. In the Hattiesburg area, GAL fees usually range between $500 and $1,000.
