Generally, an isolated act of violence can support a divorce on these grounds, but it definitely helps when there is a pattern of behavior.

A New York court recently examined an isolated act of violence with a samurai sword. There, the court strangely found that attacking your spouse with a sword may not be cruel and inhuman treatment, even when it was your daughter’s intervention that kept you from being killed. As with many legal issues, the answer begins with, “that depends.” The Mississippi Code recognizes 12 causes for a divorce:

1. Natural impotency;
2. Adultery;
3. Being sentenced to any penitentiary, and not being pardoned before arriving;
4. Willful, continued, and obstinate desertion for at least 1 year;
5. Habitual drunkenness;
6. Habitual and excessive use of illegal drugs;
7. Habitual cruel and inhuman treatment;
8. Mental illness or mental retardation at the time of marriage;
9. Bigamy;
10. Pregnancy by another, if, at the time of marriage, the husband did not know of the pregnancy;
11. Being related to one another by a degree of kindred that makes such a marriage against the law; and
12. Incurable mental illness.

So, if you can meet one of these grounds, you would be able to file for a divorce. You would have to take your spouse to court and prove to the judge the basis for you wanting a divorce.
